Street Legal ATV Inspection Criteria
Side by Side Type II
Effective October 1, 2008
An all terrain vehicle that is a type 1 or type II ATV May be
Inspected and registered as a STREET LEGAL ATV: These 2
types are defined as:
- ATV Type I
- 50 inches or less in width, unladen dry weight of 800 lbs or
less, having 3 or more low pressure tires, having a seat designed to be
straddled, designed and capable to travel over unimproved terrain...
- ATV Type II
- Any other vehicle not defined as ATV Type I, motorcycle or snowmobile designed for or capable of travel over unimproved terrain. "All-Terrain Type II vehicle" does NOT include
golf carts, any vehicle designed to carry a disabled person, any
vehicle not specifically for recreation use, or farm tractors.
- They shall be equipped and
meet all of the items to the right. which shall comply with with the
regulations of the department (41-6a-1509).
ATV Safety Inspection Information
A safety inspection MUST be completed before being registered for
the first time, regardless if it is a exempt model year. After the
first year of registration, the ATV must follow the current safety
inspection frequency of every other year. After it is eight(8)
years old it will be required to have safety inspection every year.
The safety inspection Certificate, will have the 'ATV' watermark in
the background. This watermark is present to assist the DMV with
identifying the type of registration to Process.
All stations that perform ATV inspections may charge a customer up to a maximum of $9.00 per ATV inspection.
Every Street-legal ATV is required to be registered in order to operate under
this new law. Upon registration, the ATV owner will be issued a license plate
the same size as are issued to motorcycles.

- Rear view mirrors on the right and left side of the driver in accordance with
U.C.A. 41-6a-1627 A Type I ATV requires only a left side mirror and a Type II
ATV requires both a left and a right side mirror
- A windshield unless the operator wears eye protection while operating the
vehicle
- A speedometer, illuminated for nighttime operations.
- Vehicles designed by the manufacturer for carrying one or more passengers, a
seat designed for passengers, including a footrest and hand hold for each
passenger.
- Vehicles with side by side seating. Seat belts for each vehicle occupant.
- Must not be less than 30 inches in width or exceed 70 inches in width.
Measurements must be taken at the widest point of the vehicle, including tires.
- Drivers seat must not be less than 30 inches in height, or exceed 40 inches in
height. This measurement must be made from the ground to the forward edge of the
seating position when measured on a flat level surface.
- The tire tread depth must be a least 2/32 of an inch and the tires must not
exceed 26 inches in height or be larger than the ATV manufacturer made available
for the ATV model.
Special Drivers License Required
A driver's license with a motorcycle endorsement (M)
will permit a person to operate a street legal ATV as well as a motorcycle. For
those who do not ride motorcycles and want to operate a street legal ATV they
must apply for the motorcycle endorsement (M) by passing the written knowledge
test and the riding test. Once all testing is completed the operator will have
an (M) endorsement and a (4) restriction. Those with this "M4" endorsement and restriction will only be allowed to operate the ATV and
not be permitted to operate motorcycles. (
Insurance
Every ATV must be insured in order to operate as a street-legal ATV. The same
insurance requirements that a motorcycle must have also apply to Street-legal
ATV's.

Operating Street Legal ATVs
An all-terrain type I or type II vehicle that meets the requirements of this
section may be operated as a street-legal ATV on a street or highway that is a
highway with one lane in each direction. Those highways that have
the occasional passing lanes are still considered a highway with one lane in
each direction. An operator of a street-legal all-terrain vehicle, when
operating a street-legal all-terrain vehicle on a highway in accordance with
this section, may not exceed the lesser of the posted speed limit or 45 miles
per hour.
